We aren’t lawyers but this is our best understanding as plain-old US citizens.

Dumpster diving is legal in the United States except where prohibited by local regulation. According to a 1988 Supreme Court Ruling (California vs. Greenwood), when a person throws something out, that item is now the public domain. Here is some language from that ruling: “It is common knowledge that plastic garbage bags left on or at the side of a public street are readily accessible to animals, children, scavengers, snoops, and other members of the public.”

However, if a dumpster is against a building or inside a fenced enclosure marked “No Trespassing,” you could be questioned, ticketed or even arrested by the police. Other law-enforcement tactics to discourage dumpster diving include:

– to ticket or arrest for littering (hence the legal as well as common courtesy reason to leave a trash area neater than you found it!);

– to ticket or arrest for disorderly conduct, if you are blocking a sidewalk or generally creating a ruckus while dumpster diving, or refuse to leave an area when requested to do so.

Unless a town or city has specifically made dumpster diving illegal, generally the police will not come unless called by a store manager or property owner. In our experience, this is yet another good reason to be courteous with any store employee (or resident with a dumpster) who questions the dumpster diving in progress, and to use common sense about how long an individual or group stays at any one trash location. If anyone asks you to leave, consider doing so, even if the law is on your side– there are plenty of other wasted resources to be found.

Good Samaritan Law: No Excuses for Not Donating

Store managers will claim that food in their dumpster cannot legally be consumed by humans, or that they cannot donate or give it away. This is either ignorance or lies. If you have the patience to educate, you may want to bring up the Good Samaritan Food Donation Act that has has been the law since the 1990s.

Some people suggest telling store managers you are collecting food to feed livestock or for a compost pile and if you don’t want to make a political point on the waste this will usually work. Some managers will even tell you when certain items are discarded (ie; produce), and encourage you to come get them. The main thing that food stores are worried about is¬† someone getting sick from what they throw away, and then suing them.

There is backlash in a number of communities on the issue of “theft” of recyclables from city recycling bins. Metal can often be sold at prices that make scavenging aluminum (especially cans with a fixed deposit), old appliances, and even power cords a viable cottage industry. A number of cities now have laws against this kind of dumpster diving with a vehicle. Most cities will not harass the small-scale scavenger with a granny cart or bicycle.

“Warning, do not play on in or around dumpster” — such signs are for the protection of the people who own or rent the dumpsters, in case someone gets hurt, to avoid liability.

Supreme Court ruling on dumpster diving When it ruled in the Gravewood decision in 1988, the US Supreme Court was looking to protect cops, not dumpster divers. Nonetheless, their ruling is the overall US law, unless a municipality specifically makes trash picking illegal.

You see Today I was told and shown proof of what might be a scandal within Racine County  Goverment, as I understand what information is being debated I will let others write the story, for IMHO it is one that needs to be written well and we need to read.

When it comes out I will share via Twitter-Facebook and Linkedin. I also understand that come Monday morning or before depending when Lawyers for the Black Bar owners read email they will have and are expected to act on the information. Who knows perhaps the RICO may drag in elected officials in Racine County.
What is shocking to me is how now under the Police State of Racine County if you seek  information or God forbid speak out on the leadership and your called a terrorist.

The County Roads or Rich White Boaters?

So today my wife and I drove to Janesville, we took mostly County roads to Hwy 43.

I must say that some of the roads were almost unable to be driven on the roads near Raynomd  very very bad. We know this is due to the long hard winter, that is no ones fault now nearing Spring we can all see how much damage they have suffered, again no ones fault that the roads are bad.

However with the coming warm weather will the County fix the roads or will money be pissed away on the Marina?

Will Jim Ladwig take care of the roads in Racine County or will the Mythical Boats who are thought to be the saving grace of Downtown Racine see the money?

I would hope that the piss poor roads would get priority over spending for the Rich white boaters (who many think are not coming) after all we the voters have to drive on the roads to work, to school, to wherever do we not?

Should not we who live here have farms here who have no other choice then to use the roads come first?

How in the name of God can Jim Ladwig do anything else then do the basic job of Goverment and fix the roads?  What excuse could he have not to?

Yes it might upset the Downtown Racine folks if the County put more $$ into the roads and that took $$ from the Harbor. Too bad so sad.

The County Goverment is busy raping the tax payers over Reef Point Marina to worry about the Mayor  and then the County and City said they work together on the Uptown pillaging

So what to expect from my crystal ball

The Uptown plan that IMHO has already been done will sail to get made law of the city, as this happens members of the Bid board or fronts for them will open business to take advantage of this.

Expect to see a restoration company that will focus on historical rehabbing of old buildings some of the first jobs will be for buildings that just happen to be a focus of the Uptown Plan.

The Bank will come under close watch by the City of Racine as a first step to change ownership from the current owner to someone to in line with Mayor John Dickert

Gateway will open some type of Center in the Uptown,  as a sop   to Alderman Shields part of it will be used for helping Black kids to stay in School since IMHO the Good old boys do not want Blacks who can read/write do not expect much with this.

Since Gateway has an Open Check Book expect them to spend the money to get something going and then we see the good old boys say how great the Uptown Plan is doing in the Media the Mayor controls! Are you not happy!

The idea is to create a way to raise property values (Hear about the new City Assessor?) Not only to for more taxes BUT to sell Bonds! See Dickert needs more Bond sales to build his toy called Rootworks oh who came up with that idea?!  But with the falling property values in Racine  The city may not be able to sell more, but say the City value goes up  by a few 10’s million’s then the City can and will sell more bonds and Dickert’s pals must be paid, hell for that matter Jim Ladwig’s GOP pal’s must get paid.

Will the City be able to raise property Taxes and help to drive out the poor blacks out, creating empty houses for flipping opportunities for cronies from Builders to Real Estate folks .

In 5 years will we have as many poor blacks in the Uptown or will Mayor John Dickert have as I think, he wants a more white Racine.

End result tax payers get fucked, The Black residents get fucked the cronies get paid.

Predictions 2014!

My Predictions for 2014 my guess is as good as yours!

I did O.K. in my predictions for last year, lets see how I do this year!

Not in any order

 

1) Porter’s does not happen.

2) A member of the City Council starts the effort to “Claw Back” Money given to Delta Hawk by the City of Racine, gets slapped down.

3)  Two Ethics investigations are requested on activities by the City of Racine. This will lead to more press on who makes up the Bord of Ethics and links to the Mayor of Racine.  Mr Sleepy continues to nap

4) By Spring of 2014 more businesses close in Downtown Racine.

5) Spring of 2014 the County is suggesting more money is needed for Reef Point Marina. The effort will pass the County Board.

6) Racine County will get behind the effort for a new arena for the Bucks. This will take the form of a .05% increase in the sales tax.

7) City of Racine loses more Court fights over property assessments

8) The City of Racine credit rating is downgraded again.

9)  One of the last major employers starts to move out of the City.

10) Rootworks  runs out of money

11) The Uptown Project begins, however  due to the court fights over demolition of a blighted building at 1516 Washington Ave, puts a hold on the efforts. This gets nasty.

12) A sitting Aldermen resigns

13) Paul Ryan loses Reelection

14) The film “Pattern of Practice”  premiere opens in Milwaukee to a packed house. Strong openings on the east coast. Mr Spodick is vindicated.

15) Tom Homes files his law suit on the City of Racine/Park 6

 

Lets see how right I am.

 

 

The Book Series

 

 

After consultation with a pal who has also written a few good selling E- Books via Smash Words and Amazon. I have come to the conclusion to write a series of books about the Corruption in Racine as I and many others see around us .

I will be looking at the dealings of The Mayor of Racine John Dickert.

The first Book will show a who’s who of Dickert’s pals and the role they play on City of Racine Boards, how that helps to get the Mayor’s agenda finished.

The next two will be about Delta Hawk   and Team Porters two projects sucking up tax money yet very little seen going on with them.

The Books will be less then 100 pages each and have  documentation in them (Copies of Minuets of meetings, Records from RCEDC )

The first book will cost about $1.00 the rest I am thinking less then $10.00 each

Since the stories I talk about will be far longer then a newspaper be interested I thought the Idea of an E-Book would be the best way to go about bringing the readership of this blog information on the game playing going on here under Mayor Dickert in the City of Racine.

Will Racine prove to be the most corrupt small city in the U.S.A.  Time will tell.

Good question when will they?

The Mayor got the City of Racine (read the residents) of Racine to pay his legal bills (about 100K)   We got to pay for his trip to France (who paid for his kin to go?) Who went with him?

We will be paying him to go to Mexico to bring Mexican Companies to Racine, with our high taxes , the hoops new businesses  have to jump and the way this City treats Minorities, will anyone come?   Yet The Mayor will be going, are your streetlights still on?

There are many buildings in Downtown Racine behind on back taxes. Some very much so. Why has the County Executive  not started the action needed to take them? If in fact Downtown Racine is booming as we are told it is, should it not be easy to resell them?  Maybe its time to expose the fiction of Downtown Racine? Perhaps we might find out that some business  are having issues paying venders? If that is the case why  Downtown is not booming is it?

In fact if J Way lays off say 50 from the Downtown location, what damage will that do? Maybe the County will give more money to Dickert’s pals is that not the job of folks living near Waterford?

Should not the Mayor’s pals some who have benefited greatly from contracts from City Hall at least insure the property taxes on the building they rent are being paid on? Begs the question if rent is being paid,is it?

How much $$ is spent on Downtown Racine to keep it looking alive? What’s the total amount being paid by the County on Reef Point Marina?

How much will farmers from Union Grove be chipping in for the Uptown?    Will FOJ’s get the work?

Yet vs looking into how the City is speeding $$ with I feel the O.K. of the County (Hell West of the I is rich so lets soak them!) for the Uptown the site of actions of the City of Racine that started yet another legal fight!

When do we call the Mayor to account?

IMHO I think that the Mound issue is not over yet, until a deal is signed in writing.

How much did Racine County lose on Reefpoint this year?   How much does the county plan to spent in reinvesting in this?

Has anyone said how long before “we” see a return on all the Goverment spending on this? Or is this nothing but a game to funnel money to the pockets “The right people” on the County Board?

Is this somehow going to be used as a segue to see more spending for the rich white of Downtown Racine?

How do you think the voters west of the I will feel?
